AG gets case involving Colbry's role in drunk-driving crash

VENICE TWP. - Shiawassee County Prosecutor Randy Colbry is under investigation for suspected drunk-driving in connection with a two-car crash Tuesday afternoon.

Colbry, who has not been arrested or charged at this time, was involved in a crash about 2:48 p.m. Tuesday at the corner of M-21 and Vernon Road.

The Shiawassee County Sheriff's Office is investigating the crash and has turned over the case to the Michigan Attorney General's office.

A witness said Colbry, 59, allegedly attempted to leave the scene before driving into a ditch. A sheriff's deputy detained him a short distance from the crash site and the prosecutor was transported to Memorial Healthcare in Owosso.

The driver of the other vehicle was identified as a 55-year-old Owosso man.

The Sheriff's Office stated in a press release Wednesday morning that “alcohol may have been a factor in the crash” and Sheriff George Braidwood said a blood alcohol test was performed at Memorial Healthcare, although results were not available.

County Administrator Margaret McAvoy said she spoke with staff in the prosecutor's office who indicated Colbry was in his office Tuesday morning and left for lunch. She also said Colbry is considered out sick today and Wednesday.

“He's going to decide what he needs to do, based on what his physicians recommend,” McAvoy said. “Right now he's out sick.”

Perry resident William Gibson said he witnessed the crash Tuesday and said he saw a Dodge Durango drive through a stop sign and strike another vehicle.

“I was coming up Vernon Road from Shipman (Road),” Gibson said.

He added he witnessed the Durango “slam on its brakes at the intersection and (go) through the stop sign.”

Gibson, who works as a contract delivery driver for The Argus-Press, said the Durango then “gunned it and plowed into a Pontiac G6 convertible and then took off.”

He said the Durango was “probably doing about 70 (mph) and swerving all over the road.”

Gibson said he called 911 and informed Shiawassee County Central Dispatch that he was following the Durango involved in the crash. The northbound Durango turned left onto Shipman Road and “got up to the curve and lost control of the vehicle and went into the ditch.”

“That's when I got out and got the license plate number,” Gibson said. “(The driver of the Durango) successfully made it out of the ditch and took back off. And then I hopped back in my car and took back off.”

Gibson said he then pursued the driver and witnessed a Shiawassee County Sheriff's Office vehicle pull the vehicle over on Lytle Road. He said the “cop then yanked him out of the car.”

Gibson said he saw the driver of the Durango and later identified him as Colbry.

“He had on a blue suit and a tie and he couldn't walk by himself,” Gibson said. “(The officer) then walked (Colbry) back to the car and put him in the car. He then gave me the OK to take off.”

Gibson said he did not see an ambulance at the scene, but talked to a deputy who told him the driver was transported to Memorial Hospital.

Memorial Healthcare Communications Specialist Vicki Hemenway said the hospital “was not able to release any information of that patient” and that a patient has to agree to give out information.

She added that “there is no record of that patient on any registration here.”

The other driver did not seek treatment.

Both leaving the scene of an accident and operating under the influence, first offense, are misdemeanors, according to the Michigan State Legislature Office.

Calls to Colbry's office and home were not returned by press time.

A representative for the attorney general's office also did not return calls.

From what I have heard, it sounds as though the alcoholism is a family issue, as I have heard that his son has had issues with consuming alcohol and getting behind the wheel as well. " It is amazing how people draw their own conclusions. Kudos to the Sheriff's Department for handling this in a professional manner. The report was written and forwarded to the AG. While Colbry appears to be in the wrong, there was no FELONY committed. There was a deputy that did his job and did it well, so don't blame the sheriff or his people just because you have a criminal history and a bone to pick with the prosecutor. " Unfortunately, as the top cop in the county he is unarrestable. That is why the Attorney Generals office is involved. He is also an elected official. As such, he can only resign or be recalled for the time being. I'm pretty sure that until he is convicted, he can't be administratively removed by a higher power. This is one of those instances where patience is required, just look how long it took to get rid of Kilpatrick in Detroit. I think that it will be very difficult for him to remain in office regardless, even if he is not convicted. Now is the time for a qualified individual to begin a recall campaign. My family was hit by a drunk driver, who left the scene, went 2 miles down the road and hit a tree and was picked up walking away from that accident. The driver was charged with failure to report an accident. The drunk was given 6 months probation. She could have killed my family, but it didn't matter! I certainly did not vote for him!! "

I can't believe he was elected AGAIN. There seem to be so many people that know what a hypocrite he is. So how did he win? Too many people forget to vote? Mr. Colbry was elected by the people, If he is charged, he should step down, the people will demand it.
I know people do stupid things and understand he has never had this happen before. I also know a few other people who made the the same mistakes in the past, they steped down and moved on in life. Its the right thing to do! "

I think it is up setting that know one is really focusing on the fact that he drove off. Maybe he had a drink, or two. But he drove off leaving a man in a ditch. The victims car was coming down M-21, probably traveling 50 to 60 mpg. A family could be picking out a casket right now, and this man is sitting in his home! On his lunch break during work hours? In between coming in and out of the court house participating in court trials??
